Nonrenewal of the secret agreement on November 25, 1941 of no significance. Exhibit 2694. The prosecution attaches no significance to the fact that as the defense contend (Defense exhibit 2694), the secret agreement was not renewed at the time of prolongation of the anti-Comintern pact on November 25, 1941. The circumstances pertaining to this period will be considered separately and the Tribunal will judge the actions of Japan by more substantial fact than the formal nonrenewal of the secret agreement, which as such had already played its role by that time. The Tribunal will judge the anti-Comintern pact, its nature and its aims on the basis of a historical criterion ?Çô that is on the basis of the results of the development of these relations of alliance. These results were the Tripartite Pact.
