Tavenner states his belief that, given the fact that the prosecution was unaware that the chief counsel for UMEZU was possibly a war criminal, "any action on our part at this time when the Prosecution's evidence is about complete, looking toward disbarment from participation in the trials, would have the practical effect of depriving the accused [UMEZU] of counsel." Also mentions the status of the assistant counsel as relation of the accused. Based on the preceding analysis of the both the chief counsel and assistant counsel, Tavenner recommends that it is "inadvisable to take any action in the matters."
