End comment states: "The foregoing communications would ordinarily be entitled to the privileged classification but aside from their revealing an increase in the United States Force in the Pacific, they add little proof, if any, to justify the action of the Accused or their governmnet. The operational plans without further explanation in these documents might appear to be an aggressive tendency whereas they were unquestionably defensive measures. It is, thereofre, bringing in references to other documents without offering them and thus leaving a presumption instead of proving the desired fact."
