TO: Mr. Frank S. TAVENNER, Associate Counsel of International Prosecution Section
SUBJECT: Medical report for OKAWA, Shumei
It has been determined previously by yourself and other Doctors on the board of medical officers, appointed by the prosecution and Defense, that the accused OKAWA, Shumei is suffering from a serious mental disease or disorder.
We have requested a further medical examination with a view to ascertaining whether his mental condition is temporary or permanent.
(1)Whether, both at the present time and at the time during the period 1928 to date, the accused was so far free from mental defect, disease, or derangement as to be able, concerning the particular acts charged, both to distinguish right from wrong and
(2)Whether he had the capacity to keep from doing wrong, and adhere to the right.
(3)Whether, at the present time, he has the mental capacity or ability to either understand the nature of the proceedings against him or to do what is necessary to present his defense and intelligently
