Tavenner gives his opinion of TANAKA as a witness including expressing his surprise that the defense counsel would vouch for his integrity given that he has been such an important witness for the prosecution. Cautions that the "utmost care in cross-examination" must be used. Given that TANAKA stated "he was not present when the fighting began and therefore . . . has no first-hand knowledge of what occurred before his arrival" Tavenner suggests that TANAKA can be dropped as a witness without further cross-examination after this point is made clear.
